Compliance

Introduction

The Compliance area was designed to help you stay on top of items which could affect compliance with Ontario labour legislation and also help you determine the level of risk when placing an employee on an order. This is driven by the requirements of Bill 139, Bill 148 and the Health & Safety Initiative in Ontario.

COMPLIANCE TRAFFIC LIGHT

In the Person file, on the Summary tab, note the traffic light in the Compliance section. This is used to draw attention to Assignment Employee files and indicate possible issues with compliance.

Green Light – If an employee has completed all the mandatory sign offs (the Sign Offs Complete is Yes) and has worked less than 13 weeks they will have a green light in the Compliance Zone. Providing they meet all other requirements for your position you may place them on an order.

Yellow Light – If an employee has not completed the mandatory sign offs (Sign Offs Completed field is set to No) and/or if they have worked more than 13 weeks they will have a yellow light. Best case scenario, you would want to put them on an order where you can cover the amount of termination pay that may be needed.

You can see the total number of weeks the person has been employed in the Current Tenure field and the estimated # of Weeks Notification as well.

We recommend contacting the Risk Management Team for further guidance on dealing with Assignment Employees who may require Termination Notice or pay in lieu of Notice before taking action

Red Light – If an employee is Red, talk to your manager before proceeding. You will be unable to add this Person to an order. Possible Reasons for a Red Light:

  • Assignment Employee has Current Tenure with organization for 5 years or longer.
  • Assignment Employee has been set to a Qlevel of 66 – This is set at People2.0 by the Risk Management department and only done under severe circumstances. To learn more about this status, you can contact the Risk Management team or your Client Service Specialist.

It is very important that everyone who is involved in placing temporary employees out to work in Ontario has a good understanding of Bill 139 and Bill 148. Detailed training on Bill 139 and Bill 148 is available through P20 Risk Management. Please contact the Risk Management department for more information on Bill 139 and Bill 148.

In the Compliance area you will also manage the permission to email Job Assignment Notifications (JANs) to your Assignment Employees. Providing an Assignment Employee with details about their assignment in writing is a requirement of Bill 139.

When the Assignment employee has completed their Section 2 Sign off and has agreed to receive information via email you should update the Email JAN field on the employee file to Yes. If you do not do this step, you will not be able to email a JAN to this person when you put them on an order in Stafftrak.
